Terms of Use & Booking Conditions
Last updated: 26 October 2026
Welcome to Holiday Morocco Tours. These Terms of Use (“Terms”) apply to your use of the website holiday-morocco-tours.com (the “Website”) and to every tour, desert trip, camel trek, day trip or tailor-made holiday you book with us (the “Services”). By using the Website or confirming a booking, you agree to these Terms. Please read them carefully before booking.
1. Who we are
The Website and Services are operated by Holiday Morocco Tours, a family-run local tour operator based at 77 Boulevard Rachidi, Casablanca, Morocco (“we”, “us”, “our”). We organise private and tailor-made tours across Morocco, including departures from Marrakech, Fes, Casablanca, Agadir and Tangier, imperial city tours, Sahara desert trips to Erg Chebbi (Merzouga) and Erg Chigaga, camel trekking and day trips.
2. Using the Website
- The information on the Website (itineraries, photos, descriptions and prices) is provided for general guidance. We work hard to keep it accurate, but itineraries are suggestions and may be adapted to your needs, the season and local conditions.
- You agree not to misuse the Website, including attempting to gain unauthorised access, introducing malicious code, sending spam through our forms, or copying content for commercial use without our permission.
- The Website may contain links to third-party sites (for example TripAdvisor, Facebook, Instagram or Google Maps). We are not responsible for the content or privacy practices of those sites.
3. Booking requests & confirmation
- Submitting a booking or contact form, emailing us or messaging us on WhatsApp is a request, not a confirmed booking. We usually reply within 24 hours; if you have not heard from us within 48 hours, please check your spam folder or contact us by phone.
- A booking is confirmed only when we send you a written confirmation (by email or WhatsApp) setting out the itinerary, dates, number of travellers, services included and the agreed price, and, where requested, we have received your deposit.
- The person making the booking must be at least 18 years old and confirms they are authorised to accept these Terms on behalf of everyone in their group.
- Please give us accurate details (names, number of adults and children, ages of children, pick-up location, arrival details and any special requirements). We cannot be responsible for problems caused by incorrect information.
4. Prices
- Prices are shown in Euros (EUR) per person and depend on group size, season, vehicle and accommodation category. The price in your written confirmation is the price you pay.
- Unless stated otherwise, prices typically include: private transport in an air-conditioned 4×4 or minibus, fuel, a driver-guide, the overnight stays listed (with breakfast and dinner), the desert camp night and camel ride where part of the itinerary.
- Unless stated otherwise, prices typically exclude: international flights, travel and health insurance, monument and museum entrance fees, lunches and drinks, local guides in cities where not specified, tips, and personal expenses.
- Children: we offer a reduction for children under 12 and children under 5 travel free of charge, unless your quote says otherwise. Children must share a room with an adult unless a separate room is booked.
- We reserve the right to correct obvious errors in published prices. If an error affects your booking, we will tell you before confirming it.
5. Deposits & payment
- Many of our tours can be booked with “book now, pay later”. For some bookings, especially multi-day tours, luxury tours, high season or tours requiring advance hotel and camp reservations, we may request a deposit to secure your dates. The deposit amount will be stated in your confirmation.
- The remaining balance is normally paid in cash (EUR or Moroccan Dirham) on the first day of the tour, or by another method we agree with you in writing.
- Any bank, transfer or card fees charged by your bank or payment provider are your responsibility.
- If a requested deposit or balance is not paid on time, we may treat the booking as cancelled by you, and Section 6 will apply.
6. Cancellation by you
You may cancel your booking at any time by writing to us by email or WhatsApp. The cancellation takes effect on the date we receive it. Because we reserve hotels, desert camps and vehicles on your behalf, the following charges apply to bookings where a deposit or payment has been made:
| Notice before tour start | Cancellation charge |
|---|---|
| 30 days or more | Full refund of amounts paid, minus any non-refundable bank or transfer fees |
| 15 to 29 days | 50% of the deposit is retained |
| 7 to 14 days | The full deposit is retained |
| Less than 7 days, or no-show | The full deposit is retained, plus any non-refundable costs already incurred on your behalf |
No refund is given for services that are not used once a tour has started (for example, if you leave a tour early or skip an activity). We strongly recommend travel insurance that covers cancellation.
7. Changes to your booking
We are a private, tailor-made tour company, so we are happy to adjust dates, routes or accommodation whenever we can. Change requests must be made in writing. If a change increases our costs, the price will be adjusted and confirmed with you before the change is made. Changes requested during the tour are subject to availability and any extra cost will be paid locally.
8. Changes or cancellation by us
- Itineraries may need to be adjusted because of weather, road conditions, closures, local events or for your safety. Your driver-guide may change the order of visits or replace a visit with a comparable one. These operational changes do not entitle you to compensation.
- If we must make a significant change before departure (for example, a different date or a substantially different itinerary), we will contact you and offer an alternative. If you do not accept the alternative, you may cancel and receive a full refund of the amounts you have paid us.
- If we cancel your tour for reasons other than force majeure or your own breach of these Terms, we will refund all amounts you have paid us in full.
9. Your responsibilities
- You are responsible for holding a valid passport, any visa required for Morocco, and complying with entry, customs and health requirements.
- Please be ready at the agreed pick-up time and place. Delays may shorten the day’s programme.
- We ask travellers to respect local customs, communities and the natural environment, especially in villages, religious sites and the desert. We may end the services of anyone whose behaviour endangers others, breaks the law or seriously disrupts the tour, without refund.
- You are responsible for your personal belongings and valuables throughout the tour.
- Please tell us before booking about any medical condition, reduced mobility, pregnancy, dietary needs or allergies so that we can advise whether the tour is suitable and make reasonable arrangements.
10. Health, safety & activities
Our tours include long drives on mountain roads, high-altitude passes, desert conditions and activities such as camel rides and trekking. These involve inherent risks. Participation is at your own risk, and you should only take part in activities you are physically able to do. Please follow the instructions of your driver-guide and camel guides at all times. Desert nights can be very cold and days very hot; we will advise you on what to bring.
11. Travel insurance
Comprehensive travel insurance is strongly recommended and is your responsibility. It should cover medical expenses, emergency repatriation, cancellation, curtailment, personal belongings and the activities included in your tour.
12. Accommodation & suppliers
Hotels, riads, kasbahs and desert camps are selected for quality and authenticity. Standards in remote areas may differ from those in cities or in your home country. If a booked property becomes unavailable, we will provide accommodation of a similar or higher standard. Suppliers’ own terms and conditions may also apply to the services they provide.
13. Limitation of liability
- We will provide the Services with reasonable skill and care. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be limited under applicable law.
- We are not liable for loss, injury, damage, delay or expense caused by your own actions, by third parties unconnected with the Services, by events outside our reasonable control, or by your failure to follow safety instructions.
- Except where the law requires otherwise, our total liability to you in connection with a booking is limited to the total price you paid us for that booking.
- We are not responsible for missed flights, trains or connections arranged by you. Please allow enough time between the end of your tour and onward travel.
14. Force majeure
We are not liable for failure to perform or for changes caused by events beyond our reasonable control, including extreme weather, sandstorms, floods, earthquakes, road closures, strikes, epidemics, government action, civil unrest or other unavoidable and extraordinary circumstances. In such cases we will do our best to offer an alternative arrangement or refund any unused services that we are able to recover.
15. Complaints
If something is not right during your tour, please tell your driver-guide or contact us immediately so we can try to fix it on the spot. If a problem cannot be resolved locally, please send us a written complaint within 30 days of the end of your tour. We will reply as quickly as possible and aim to resolve it fairly.
16. Intellectual property
All content on the Website, including text, itineraries, photographs, logos and design, belongs to Holiday Morocco Tours or is used with permission. You may view and print pages for personal, non-commercial use. Any other use requires our prior written consent.
17. Reviews & photos
We welcome honest reviews on TripAdvisor and other platforms. If you send us photos or testimonials, you allow us to publish them on the Website and our social media pages, with your first name and country only, unless you ask us not to. You may ask us to remove them at any time.
18. Governing law
These Terms are governed by the laws of the Kingdom of Morocco. Any dispute will first be discussed in good faith with a view to an amicable solution. If no solution is found, the competent courts of Casablanca, Morocco will have jurisdiction, without depriving consumers of any mandatory protections they may have under the law of their country of residence.
19. Changes to these Terms
We may update these Terms from time to time. The version published on the Website on the date of your booking confirmation applies to that booking. The “Last updated” date above shows when they were last revised.
